Digital Estate Planning – We will explore the definition of digital assets and how to access, secure and distribute them. You will learn the risks and obstacles associated with planning for digital assets, such as potential privacy violation issues and the impact of federal and state hacking laws. We will also cover various planning techniques used to avoid pitfalls and ensure smooth administration of digital assets.

Special Needs Trusts – We will explain the importance of supplemental needs trusts, when to create them and how to fund them as well as the difference between a third-party trust versus a self-settled “payback” trust. A recent New York trust case will be presented to explore the role and responsibilities of corporate trustees of supplemental needs trusts.

Same-Sex Family Planning – Since U.S. v. Windsor, the landmark Supreme Court case that defeated a controversial federal law denying equal treatment to same-sex spouses, some 35 states recognize same-sex marriage. We will recap this trailblazing case and outline issues that remain for same-sex spouses, with an emphasis on estate planning.
