NYC Department of Finance (DOF) is responsible for administering the tax revenue laws of the city fairly, efficiently, and transparently to instill public confidence and encourage compliance while providing exceptional customer service.
Division Description:
The Legal Affairs Division serves as the in-house legal department for DOF, providing professional and comprehensive legal advice and services in support of a full range of city tax and other revenue-related matters. Legal Affairs Division attorneys and staff handle a wide range of legal issues, including real property taxes and exemptions, business income and excise taxes, collections, parking violations, treasury, land registry, FOIL, and employment law.
Job Description:
Within Legal Affairs, the Collections Unit supports the agency's debt collections efforts, handling the collections of business and excise tax warrants, bankruptcy issues, collections of environmental control board violations and may also collect other debt. Reporting to the Director of the Collections Unit, the unit seeks two experienced attorneys to work independently to represent the agency in debt collection matters including ECB debt, legal research, review of debt and other legal and collections related documents for collections, negotiation of agreements with debtors, mortgage foreclosure matters, bankruptcy issues and legal process to enforce judgments.
Under general supervision with latitude for independent and unreviewed action and decision, performing more sophisticated agency legal work, the collections attorneys' responsibilities will include the following:
• Perform legal research and draft memorandum, legal responses and other documents as needed on various debt collection matters, including some complicated matters.
• Research and review debt for collections using agency computer systems.
• Prepare, review and/or sign legal collection and enforcement documents including executions, information subpoenas and restraining notices as needed.
• Handle mortgage foreclosure and tax lien foreclosure matters and submit surplus money claims and if required prepare motions and handle oral argument regarding priority issues.
• Collect Debt, including Office of Administrative Trials and Hearings (OATH/ECB) violations and tax warrant debt.

Minimum Qualification Requirements:
1. Admission to the New York State Bar; and either "2" or "3" below.

Through an intense six-week summer program, the NY LEO Program assists minority, low income and economically or educationally disadvantaged college graduates in acquiring the fundamental and practical skills necessary to succeed in law school. The NY LEO Program is administered by the Honorable Kathie E. Davidson, Dean of the New York State Judicial Institute. Students live on campus and participate in the program full-time. Experienced law professors provide instruction in first-year law school core courses as well as in legal research, writing and analysis. Job Description

The City of New York’s Office of Administrative Trials and Hearings (OATH) is the nation’s largest administrative tribunal, holding approximately 400,000 trials and hearings a year.  OATH is seeking to hire twenty (20) attorneys to serve as special education hearing officers in the administration of special education impartial due process hearings for students with disabilities, 3-21 years of age, pursuant to section 200.1(x) of the Regulations of the Commissioner of Education. 
The federal Individuals with Disabilities Education Act (IDEA) has established due process procedures for use when a parent and a school district disagree about the identification, evaluation, educational placement, or the provision of a free appropriate public education for a student with a disability.  Such disagreements may be resolved through an impartial hearing, a formal method in which the parties present and refute evidence before a hearing officer.
Responsibilities will include, but are not limited to:
• Conducting hearings by remote means and in person, evaluating evidence, and maintaining administrative courtroom procedures.
• Conduct settlement conferences between parents and the New York City Department of Education.
• Issue written decisions.
• Conduct legal research regarding state and federal education laws, the IDEA, and special education programs.
• Maintain a high degree of professionalism and effectiveness in handling assigned matters promptly.
• Handle special assignments and projects including but not limited to oral and/or written presentations.

New York State Education Department impartial hearing officer training and additional training will be provided at no cost to candidates after hiring.

ADMINISTRATIVE LAW AND REGULATORY LITIGATION

The Law Department is now accepting applications for the position of Assistant Corporation Counsel in the Administrative Law & Regulatory Litigation Division. The Administrative Law & Regulatory Litigation Division handles State and Federal court proceedings brought by and against the numerous City agencies that are responsible for administering and enforcing laws and regulations in the areas of public health, land use, licensing, use of the streets, transportation, public housing, building and fire codes, among others, so as to enhance the quality of life of its citizens and visitors. Some of these actions include challenges to the provisions of law themselves, while most dispute the application of a particular legal requirement in a specific context. Many cases raise constitutional claims, including First and Second Amendment challenges, challenges to various City regulations and orders on Due Process and Equal Protection grounds, among others; and many cases involve challenges that the regulations or policies at issue violate state or federal statutory provisions.  The Division handles cases for over 20 different City agencies and the five City-run Pension Funds.  In addition to our varied defensive practice, the Division brings some civil actions to obtain compliance with regulatory requirements, and prosecutes code violators in New York Criminal Court to punish their non-compliance and ultimately bring about code compliance. The hired candidate will be responsible for independently handling a caseload comprised of these sorts of actions from beginning to end including preparing pleadings and affidavits after reviewing agency records and consulting with agency representatives, researching and writing memoranda of law, conducing necessary discovery, making court appearances to argue motions, and taking cases if appropriate to trial, as well as prosecuting violations and misdemeanors in Criminal Court.

All applicants must be admitted in the State of New York with at least two years of experience following graduation from an ABA approved law school. Applicants must have superior organizational, time-management, research and writing and oral advocacy skills.

COMMERCIAL AND REAL ESTATE LITIGATION

The Commercial & Real Estate Litigation Division of the New York City Law Department seeks an experienced litigator to represent the City and related entities in commercial litigation matters. FAMILY COURT – BRONX AND BROOKLYN OFFICES

The New York City Law Department is accepting applications from admitted attorneys with a minimum of three years of litigation experience in criminal or juvenile justice for the position of Assistant Corporation Counsel (ACC) in the Family Court Division. Our mission is two-fold:  Juvenile Justice and Interstate and International Child Support.   This position is specifically for the Juvenile Justice practice.  When addressing cases of youth charged with criminal acts,  the law requires a rehabilitative determination of the outcome that best meets the needs of the youth and the protection of the community. Family Court Division staff work under the fastest timelines and with complex situations to achieve that goal. 

The position offers the opportunity to join approximately 250 people in dedicated service to the children, families and communities of NYC.  We are a citywide Division with locations in all five boroughs.  We investigate cases involving criminal allegations that range from minor offenses often emanating from conflict within families which are immediately met by dedicated case support teams geared to assist; to complicated cases of youth involved with assaults, robberies, weapons possession, arson, attempted homicide and homicide and sexual offenses handled by specially-trained personnel.  Assistants are given the opportunity to train for and join the Division’s Special Victims Unit which handles complex litigation around sex offenses and other related cases and whose members are nationally trained and certified in forensic interviewing and other specialized skills; and/or the Division’s Major Case Unit which handles advanced litigation dealing with the most serious charges and challenging needs and whose members work closely with federal, state and local law enforcement to address safety concerns within communities; and the opportunity to qualify to be cross-designated special ADAs in most of the NYC District Attorney offices where they work alongside ADAs on Adolescent Offender cases being removed to Family Court under the historic Raise the Age legislation.

Attorneys carry  their own caseload and work collaboratively with others in a team approach to cases; and can second chair the most complex cases handled by senior attorneys.  The responsibilities include but are not limited to: interviewing victims, civilian witnesses and police officers; working with law enforcement to obtain, evaluate and analyze evidence to determine the viability of a case thereby determining whether the case can be filed or must be declined. If the case can be filed in court, deciding whether a community based diversion is appropriate; if the case is filed, drafting depositions; filing petitions conducting and providing discovery including body worn camera, DNA, video and Giglio evidence; preparing and conducting pre-trial hearings including pre-petition detention and probable cause hearings, which determine the custodial status of the youth; constitutional suppression hearings to determine the admissibility of evidence; fact-finding hearings (similar to trials in adult criminal cases), which determine whether the juvenile committed the acts alleged; and dispositional (sentencing) hearings.  The Assistant is supported by legal supervisors and legal support professionals.  Case assignment is centered around a vertical prosecution model. 

The Family Court Division is ideal for attorneys with a passion for juvenile justice, and helping communities thrive.  Suitable members of the Division possess the ability to investigate cases, analyze and then advocate for appropriate outcomes on a case-by-case basis, and to expertly conduct hearings and trials in a fast-paced environment with the ultimate goals of rehabilitation of the youth and the enhancement of the safety of the community.

Every office within the Division is composed of enthusiastic, dedicated personnel who contribute to the vibrancy of the work.   The office location of the Assistant will be flexible depending on factors such as space availability, preference of the individual and the needs of the Division.

• The ACC will be welcomed and may be required to attend various inter-agency and borough meetings; and to prepare and present trainings both within the Family Court Division and to other agencies and stakeholders.

• Excellent legal research and writing skills are essential to the position; and participation in special projects such as those addressing legislative, policy and operational change will be offered and may be required. Attorneys are expected to visit crime scenes and conduct interviews and other casework after hours and on weekends when necessary.

• Our work is ongoing and constant, it affects peoples’ lives.  The Division therefore operates 365 days and nights a year to meet the needs of expert case investigation as well as the rights of those in custody beyond Family Court hours.  Therefore, participation in a city-wide on-call system for juvenile justice cases that take place outside of office hours as well a rotating schedule for Weekend, Holiday Evening Court (WHEC) currently operated in the Criminal Court at 100 Centre Street  is required.  Note:  Work in the rotation serving WHEC is compensated through the granting of an RDO (regular day off) during the work week as well as transportation home at the end of the shift.

• Attorneys are required to participate in community events including school, precinct and community outreach events for community members to meet us and learn about our work; and for us to meet community members and learn from them.  

• The Family Court Division’s Juvenile Justice practice is comprised of a dynamic group of collaborative people who work together as a team.  The qualified candidate is drawn to teamwork and supportive relationships within the office, the court and NYC at large!

SPECIAL FEDERAL LITIGATION

The Special Federal Litigation Division of the NYC Law Department defends the City and its officials in civil rights cases brought in federal court in which police, district attorney or correction officer misconduct is alleged. These cases arise from contact between citizens and law enforcement officers in three contexts: police operations, the prosecution of criminal proceedings, and the custody of arrested individuals in the City's detention facilities. Suits are typically brought by those who believe their constitutional rights were violated in the course of an arrest and subsequent prosecution, or on account of events in City jails.

The Special Federal Litigation Division is accepting applications from admitted attorneys with at least two years of litigation experience for an ACC position in the division. The hired attorney will handle a caseload from inception through resolution whether by motion practice, settlement, or trial. Attorneys conduct initial investigations to determine if representation is appropriate, answer the complaint, appear at court conferences, engage in extensive discovery (paper and electronic), take and defend depositions, draft dispositive motions, conduct settlement negotiations, and, when appropriate, take cases to trial in federal court.

TORT

The Tort Division of the NYC Law Department is accepting applications from admitted attorneys for Assistant Corporation Counsel positions in various units of the division. Tort Division attorneys defend the City of New York in personal injury and property damage cases primarily in State Court. The Tort Division is currently hiring for the following units:

Pre-Trial Unit: Pre-trial attorneys handle cases while they are in discovery. They appear regularly in court to attend discovery or other status conferences and argue motions. Attorneys take and defend depositions, request and exchange discovery, engage in settlement negotiations, and write and argue substantive and procedural motions. Once they are experienced pre-trial attorneys, they also may serve as a 1st or 2nd chair of a trial, in addition to their pre-trial case responsibilities.

Vertical Unit: Attorneys in the Vertical Units are assigned Tort cases to handle from inception through resolution. Vertical Unit attorneys engage in discovery, take and defend depositions, write and argue motions, engage in settlement negotiations. When a case that a Vertical Unit attorney is assigned goes to trial, the attorney will serve as a 1st, 2nd or 3rd chair on that trial, as appropriate for their level of experience.

State Law Enforcement Defense (SLED) Unit: Attorneys assigned to the SLED Unit represent police officers in cases involving claims of misconduct. Attorneys in this unit are assigned to either handle assigned litigation tasks on a number of cases (like pre-trial attorneys) or are assigned cases from commencement through resolution (like vertical unit attorneys) either by settlement or motion. When a case that a SLED attorney is assigned vertically goes to trial, the attorney will serve as a 1st, 2nd or 3rd chair on that trial, as appropriate for their level of experience.

WORKERS’ COMPENSATION

The New York City Law Department is accepting applications for an attorney position in our Workers’ Compensation Division. The division represents the City of New York and related entities at administrative hearings before the New York State Workers’ Compensation Board. Division attorneys manage and litigate matters involving City employees whose claims for benefits are pending before the Workers’ Compensation Board. They appear at hearings and trials before administrative law judges on a daily basis. They conduct investigations and legal research in preparation for hearings and evaluate the merits of claims. They regularly cross-examine fact witnesses as well as all types of medical experts. Cases involve a wide variety of medical conditions, from de minimus to life threatening. Legal issues cover a broad spectrum, including compensability and coverage under the Workers’ Compensation Law, timely claim filing, questions of causation, medical disability, need for treatment and entitlement to wage replacement. Attorneys research and write appeals to the Commissioners of the Workers’ Compensation Board and the Appellate Division.

DUTIES AND RESPONSIBILITIES: This listing is for a two-year clerkship position starting in April 2022. The

MINIMUM REQUIRED QUALIFICATIONS: Applicants must have graduated with a Juris Doctor (JD) degree

highest court of a State, Territory, Commonwealth, or federal court of general jurisdiction of the United States.
In addition to meeting the minimum qualification requirements, applicants must also have specialized experience as
shown in the table below.

The applicant must be intellectually curious and have an aptitude and willingness to work with complex procedures

The New York State Judicial Institute is seeking a Program Director for its New York Legal Education Opportunity Program. This program is funded by a grant which permits the hiring of a Program Director, essential legal instructors, and staff.

The New York Legal Education Opportunity Program (LEO) is an intense six-week summer pre-law school program hosted by The New York State Judicial Institute. LEO’s mission is to promote academic success in law school for individuals historically underrepresented in the legal profession. LEO is designed to provide minority, low-income, and economically or educationally disadvantaged college graduates with the fundamental and practical skills necessary to succeed in law school. Students accepted to the program are referred to as LEO Fellows.

The Program Director is responsible for directing and overseeing all facets of LEO and is vital to its success. The Director’s responsibilities include: reviewing applications and selecting LEO Fellows; hiring faculty and Teaching Assistants; choosing and developing courses; overseeing the mentorship program; creating and completing evaluations of the Fellows and the LEO program; administering all academic, extracurricular, and residential aspects of LEO; assisting LEO Fellows as appropriate with any outstanding law school applications; providing any information required in connection with the grant funding; and preparing an end of program report.

The academic portion of the program will focus on analyzing cases in core legal subjects and developing legal writing skills.
