The New York State Office of the Attorney General is seeking a talented and motivated attorney for its newly created Law Enforcement Misconduct Investigative Office (“LEMIO”). The Assistant Attorney General (AAG) position provides a unique and exciting opportunity to join a first-of-its-kind statewide oversight body charged with identifying and addressing systemic police misconduct. LEMIO seeks to improve the effectiveness of law enforcement, promote public safety, protect the civil rights and liberties of New Yorkers, as well as enhance transparency and strengthen public trust in the criminal justice system. The position will be located in New York City and report to the LEMIO Chief.

The Office was created by the New York State Legislature in June of 2020 in the wake of the killing of George Floyd and its implementing legislation went into effect April 2021. The Legislature’s intent was to create a “strong, independent office” which would improve the current police oversight structure “by providing broad jurisdiction, independence, and extra scrutiny where existing systems may be failing.”

LEMIO has a broad mandate to investigate “allegations of corruption, fraud, use of excessive force, criminal activity, conflicts of interest or abuse” as well as patterns and practices of police misconduct. LEMIO will be responsible for investigating complaints, examining departmental policies and procedures, and making recommendations for reform, including disciplinary action.

Suitable candidates for the AAG position must possess the following qualifications:

  • At least three (3) years of post-graduate legal experience;
  • Knowledge of policing best practices, relevant police procedures, and reforms is also required;
  • Experience investigating and/or litigating police misconduct is preferred;
  • Strong writing, organizational, interpersonal communication, and problem-solving skills; and
  • A demonstrated commitment to public service.

The New York State Office of the Attorney General (OAG) is seeking an experienced litigator to lead its premier Investor Protection Bureau (IPB) located in New York City. The IPB is responsible for the enforcement of New York’s securities fraud laws, most significantly the Martin Act, a 100-year old, powerful anti-fraud statute that predates the federal securities laws. In the past two decades, the Office of the Attorney General has used the statute to prosecute a wide range of fraudulent conduct, including high profile matters of national importance arising from the 2008 financial crisis, structural conflicts of interest in the securities industry, frauds perpetrated in emerging areas such as high-frequency trading and cryptocurrencies, and retail investment frauds preying on New York State’s retirees.  

The IPB is seeking a leader who can build on its storied history and robust authority to protect the interests of investors in today’s financial markets, including the growing risk of fraud in environmental, social, and governance (ESG) disclosures, the marketing of complex and speculative investment products to a broad range of retail investors, and the need for greater racial equity across our financial system.

The Bureau Chief will supervise attorneys and support staff in fraud investigations and lawsuits. The Bureau Chief will also advise and oversee both the Franchise and Registration Chiefs and their Units, and coordinate with outside government agencies including other Attorneys General, state securities regulators and prosecutors, federal regulators and prosecutors, and NASAA.

Applicants must have at least ten (10) years of litigation experience, strong supervisory experience, excellent writing skills and a demonstrated commitment to public service. Litigation and trial experience in New York State Supreme Court, knowledge of investment products and financial markets, and/or a background in public enforcement or prosecution are pluses.

The Executive Division of the New York State Office of the Attorney General (OAG) is seeking an attorney with in-house counsel and government experience for an Associate General Counsel Position with the Office of the General Counsel (OGC). Experience collaborating across teams, including with human resources, reviewing contracts, and compliance are also desired.   

The Executive Division maintains the functions of the OAG and, in addition to the OGC, includes the Senior Leadership Team, Chief Deputy Attorneys General (CDAGs), the Solicitor General, and the directors of Communications, Intergovernmental Affairs, Legislative Affairs, and Research & Analytics. The Executive Division’s responsibilities include policy development, public relations, community outreach, research and analytics, drafting proposed legislation, monitoring legislation that affects the OAG, and the day-to-day administration of the Office.

The selected candidate will work for the OGC. As the in-house counsel to the Attorney General and the OAG, the OGC works collaboratively across all divisions to provide guidance and develop legal strategies and responses; draft, interpret and implement OAG policies and procedures; identify potential litigation/policy issues or strategies; implement compliance and supervise ethical determinations; interact with other governmental and legal entities; and handle employee and other confidential matters as required. This position will report directly to the General Counsel and is located in the New York City Office.

Responsibilities will include, but not be limited to the following:

  • Assisting with administrative proceedings and responding to subpoenas;
  • Consulting and collaborating with internal and external stakeholders to enhance the OAG’s ability to execute legal and legislative initiatives that address critical issues facing New York State and its residents;
  • Assisting in employment and labor law matters;
  • Assisting in developing best policies and practices for the OAG;
  • Collaborating with senior staff on internal administrative changes, affirmative litigation, and legislative and policy initiatives;

The New York State Office of the Attorney General (OAG) is seeking experienced litigators to serve as Assistant Attorneys General in the New York City Litigation Bureau.  The Bureau represents and defends the State of New York and its agencies, officials and employees in federal and state courts in civil actions and proceedings involving civil rights, education, social services, public employment, public health, law enforcement, corrections, state finance, insurance, taxation, and other litigation matters arising out of state legislation, regulations, and operations.

The Bureau’s attorneys are assigned to Sections within one of three (3) Practice Groups, which are organized according to specific client agency groupings:

The Administrative and Regulatory Services Practice Group is comprised of three (3) Sections which principally represent and defend: (1) the State’s commercial and transportation agencies including, among others, the Department of Financial Services, Department of Taxation and Finance, Department of State, and Department of Motor Vehicles; (2) the State’s judicial, environmental and labor agencies including, among others, the Office of Court Administration, Board of Law Examiners, Office of Parks, Recreation and Historic Preservation, Department of Labor, Division of Human Rights, and Workers Compensation Board; and (3) the State’s educational agencies including, among others, the State Education Department, City University of New York, State University of New York, and Higher Education Services Corporation.

The Health and Human Services Practice Group is comprised of three (3) Sections which principally represent and defend: (1) the State’s public health agencies including, among others, the Department of Health, Office of the Medicaid Inspector General, and Office of Professional Medical Conduct; (2) the State’s mental health agencies including, among others, the Office of Mental Health, Office for People with Developmental Disabilities, and Office of Alcoholism and Substance Abuse Services; and (3) the State’s social service agencies including, among others, the Office of Temporary and Disability Assistance, Department of Health, and Office of Children and Family Services.

The Law Enforcement Practice Group is comprised of two (2) Sections which both principally represent and defend the State’s public safety agencies including, among others, the Department of Corrections and Community Supervision, Division of State Police, Division of Criminal Justice Services, Division of Homeland Security and Emergency Services, and Office of Victim Services.

Across all three (3) Practice Groups, the Bureau’s attorneys are generalists who handle a wide variety of cases and substantive issues including constitutional challenges to statutes enforced or regulations promulgated by their client agencies; labor and employment litigation emanating from their client agencies’ role as employers; challenges to administrative decisions and determinations made by their client agencies under state law; and civil rights litigation, such as First Amendment retaliation, Fourth Amendment excessive force or Fourteenth Amendment due process claims, generated from their client agencies’ core functions.

The Bureau’s cases are often high profile, frequently present complex questions of constitutional law and statutory and regulatory interpretation, and generally have significant policy and financial implications for the State.  The Bureau, the largest within the OAG, offers a diverse and stimulating litigation practice with attorneys handling all phases of litigation from inception through trial and having frequent opportunities to appear in court.

Suitable candidates must possess the following minimum qualifications:

  • At least two (2) years of civil litigation experience in federal and New York state courts;
  • Superb legal analysis, legal writing and editing, and oral advocacy skills;
  • Outstanding organizational, interpersonal communication, problem solving, and teamwork skills;
  • Excellent technological skills, including knowledge of and experience with various computer software programs and case management and electronic discovery platforms; and
  • Prior complex litigation and trial experience are preferred, but not required.

Job Description

The City of New York’s Office of Administrative Trials and Hearings (“OATH”) is the City’s central administrative tribunal, responsible for conducting administrative hearings for a wide range of City agencies, boards and commissions. OATH’s mission, to provide fair and timely proceedings to resolve disputes, is achieved through independent and impartial adjudication, ensuring procedural and substantive due process.

Within OATH’s Trials Division, an OATH Administrative Law Judge adjudicates cases involving different subject matter areas, including civil service law, zoning and land use, housing, licensing, conflicts of interest, city contracts, human rights law, consumer and worker protection laws, and vehicle seizures. OATH Administrative Law Judges are subject to the NYS and NYC Codes of Judicial Conduct, and must maintain the highest standards of ethics, both professionally and personally.

Under the supervision of the Chief Administrative Law Judge, the Administrative Law Judge:

  • conducts formal trials pursuant to federal, state, and local law
  • prepares written decisions that include a summary and analysis of evidentiary and legal issues
  • presides at pre-trial settlement conferences
  • participates in and leads special projects at OATH

Appointment by the Chief Administrative Law Judge is for a term of five years.

Qualification Requirements

1. Admission to practice law for at least five years in the State of New York, and five years of recent full-time relevant legal experience gained after Bar Admission, or
2. A satisfactory equivalent.

Legal Hotline Staff Attorney - Part Time

The City Bar Justice Center (CBJC) seeks an attorney committed to expanding access to justice to join us as a Legal Hotline Part Time Staff Attorney (approximately 20 hours per week). CBJC provides high-quality, free civil legal services to nearly 25,000 New Yorkers each year who lack the resources to hire private counsel. With a staff of about 30 – roughly one-third of whom are attorney project directors with deep expertise in their respective fields – CBJC also relies on expansive partnerships with law firms, corporate legal departments, the courts, the City Bar, and other stakeholders. In 2020-21, roughly 2,000 pro bono attorneys donated services to support legal services clinics and client matter work drawn from CBJC’s dozen civil legal services projects.

Areas of responsibility include, but are not limited to:

  • Serve as part of a team of staff attorneys who answer questions and provide legal assistance on CBJC’s high-volume Legal Hotline, which typically responds to approximately 1,000 calls and online inquiries per month.
  • Provide callers legal information, advice, and referrals.
  • Conduct follow-up brief services, such as reviewing legal documents and helping callers draft simple court pleadings.
  • Help clients prepare for a court appearance or strategize the next step in a legal matter.
  • Assist in the supervision and training of staff, including legal support staff and volunteer attorneys.
  • Stay abreast of changes and updates to the law.

 

EXPERIENCE, SKILLS & REQUIREMENTS:

  • Candidates must be New York bar members in good standing with at least three years of relevant practice experience, preferably in nonprofit legal services and/or with a focus on housing, family, and/or consumer law.
  • We seek a detail-oriented self-starter with superb legal judgment and a capacity to multi-task who is creative, thoughtful, tech savvy, and has high standards in work quality, and who can demonstrate a commitment to racial and economic justice and to serving those who struggle with a lack of resources.

This is a remote work position (including post-pandemic). Our Legal Hotline staff will be expected to physically come to our offices in midtown Manhattan only on rare occasions for team-building, training, or other specific business activities.

Salary for this position is $39,000-$42,000 (annualized) based on experience and a 20 hours/week schedule. The New York State Office of the Attorney General’s (OAG) Medicaid Fraud Control Unit is seeking an attorney with experience prosecuting and/or investigating complex financial wrongdoing to serve as a Special Assistant Attorney General in its New York City office.

Utilizing the New York State Penal Law, the False Claims Act, Social Services Law §145-b, the Executive Law, and other New York laws, the Unit brings civil actions and criminal proceedings to successfully prosecute individuals and companies who are responsible for improper or fraudulent Medicaid billing schemes. Many of the Unit’s investigations are conducted in coordination with other state, federal or local government and prosecutorial agencies, and have resulted in revenue generation through the large-scale recovery of taxpayer money. Additionally, MFCU investigates reports of abuse and neglect at nursing homes and other health care facilities in New York. The importance of this work is highlighted in the OAG’s recently released report investigating allegations of COVID-19-related neglect of nursing home residents across New York State.

The selected candidate will lead team investigations of allegations of financial fraud in the healthcare industry, and of abuse and neglect of residents of healthcare facilities, present evidence to grand juries, and conduct evidentiary hearings and trials in New York State courts.

  • A minimum of four (4) years of practice experience, including grand jury, trial and/or substantial complex business litigation practice that must include criminal practice experience and preferably includes the investigation and prosecution of financial crimes;

Job Description

The City of New York’s Office of Administrative Trials and Hearings (“OATH”) is the City’s central administrative tribunal, responsible for conducting administrative hearings for a wide range of City agencies, boards and commissions. OATH’s mission, to provide fair and timely proceedings to resolve disputes, is achieved through independent and impartial adjudication, ensuring procedural and substantive due process.

Within OATH’s Trials Division, an OATH Administrative Law Judge adjudicates cases involving different subject matter areas, including civil service law, zoning and land use, housing, licensing, conflicts of interest, city contracts, human rights law, consumer and worker protection laws, and vehicle seizures. OATH Administrative Law Judges are subject to the NYS and NYC Codes of Judicial Conduct, and must maintain the highest standards of ethics, both professionally and personally.

Under the supervision of the Chief Administrative Law Judge, the Administrative Law Judge:

  • conducts formal trials pursuant to federal, state, and local law
  • prepares written decisions that include a summary and analysis of evidentiary and legal issues
  • presides at pre-trial settlement conferences
  • participates in and leads special projects at OATH

 

Appointment by the Chief Administrative Law Judge is for a term of five years.

Qualification Requirements

1. Admission to practice law for at least five years in the State of New York, and five years of recent full-time relevant legal experience gained after Bar Admission, or

2. A satisfactory equivalent.

The Labor Bureau of the New York State Office of the Attorney General (OAG) is seeking an attorney to serve in the Employment Security Section and defend against state and federal court challenges to the New York State Department of Labor’s (DOL) enforcement of labor laws and standards, and defend the DOL’s and other agencies’ decisions in the Appellate Division. This position will be located at the New York City office and report to the Employment Security Section Chief.

The Employment Security Section represents the New York State DOL on appeals to the Appellate Division, Third Department, from decisions of the Unemployment Insurance Appeal Board relating to eligibility of individuals for unemployment insurance benefits and the obligation of employers to pay unemployment insurance contributions. The Section also handles other defensive litigation involving the unemployment insurance program in both state and federal courts and represents the interests of the Unemployment Insurance Division in bankruptcy cases, foreclosures, and other multi-party litigation involving distribution of limited funds to creditors. In addition, the Section initiates civil actions to recover overpayments of unemployment insurance benefits. 

Qualification for this position include the following:

  • A minimum of three (3) years of post-graduate legal experience, preferably with a focus on appellate practice and/or complex civil litigation;
  • Superb legal analysis, legal writing and editing, and oral advocacy skills;
  • Outstanding organizational, interpersonal communication, problem solving, and teamwork skills;
  • Knowledge of major state and federal labor employment law, particularly Article 18 of the Labor Law;
  • A demonstrated commitment to public service; and
  • Fluency in Spanish is a plus.

Applicants must reside in (or intend to soon become a resident of) New York State and be admitted to practice law in New York State. In addition, the Public Officers Law requires that attorneys in the Office be citizens of the United States. A two (2) year commitment upon being hired is a condition of employment.

  • Strong PC skills, including Microsoft Teams, Outlook, Word and basic Excel
